GENERAL TERMS OF SALE
ARTICLE 1 – GENERAL TERMS OF SALE: SCOPE
The present general terms of sale will apply to orders placed via our website www.hoses-limited.com to the exclusion of all others.
By confirming his order, the client declares that he has familiarised himself with the present general terms of sale and accepts them. Any purchase made via our website signifies acceptance of the conditions detailed hereafter and it is not possible to purchase an item via our website without accepting the general conditions shown below.
HOSES reserves the right to modify its general terms of sale with each new version being indicated in the “General Terms of Sale” section and being applicable to all transactions recorded after their publication online.
ARTICLE 2 – PRODUCTS
The products made available for sale are those shown on the website on the day this is consulted, subject to stock availability. Should the product not be available, HOSES will notify the client of this as soon as possible and the order value will be reimbursed within the following thirty (30) days.
Careful attention is paid to the description and presentation of the products although these are nevertheless provided for information purposes only. The photos and text illustrating the products are non-contractual. We do everything possible to display the colours of our products as faithfully as possible. However, computer screens vary and we are unable to guarantee that your screen is displaying the actual colours.
We may not be considered liable for the presentation and representation of the products or for any possible errors or omissions. These factors will not affect the validity of the order. HOSES invites the client to refer to the description of each product to view the precise product characteristics.
HOSES’ customer service department is on hand to assist its clients with any requests for additional information by e-mail (firstname.lastname@example.org ) or by telephone (+33 1 42 78 80 62).
ARTICLE 3 – RESERVATIONS
Shoes cannot be purchased on the HOSES website. They can be reserved in order to be collected from the HOSES store at 41 rue de Poitou. Payment consequently takes place in-store.
The other items can be purchased via the HOSES website and will be shipped to the client or can be collected from the HOSES store.
ARTICLE 4 – ACCEPTANCE OF THE ORDER
When the client accepts the General Terms of Sale described here and when he clicks on the “Order” icon, he is irrevocably committed and can no longer withdraw his consent.
The automatic order booking systems used by our company are considered as constituting proof of the conclusion of the contract of sale.
The client will receive an order confirmation within a maximum period of one (1) hour, this being sent to the e-mail address he entered during the ordering process. This confirmation will summarise the essential characteristics of the order. It is archived by HOSES and is considered as constituting proof of the transaction and its date.
ARTICLE 5 – PRICES
5.1 – The prices of our products are shown in euros on our French website by default. They incorporate any possible reductions in addition to French VAT at the applicable rate on the order date.
The prices shown do not include carriage, packaging, processing and shipping costs which are invoiced as extras and which will be specified to the client at the final confirmation stage for his order.
HOSES reserves the right to modify the prices at any time but the product will be invoiced based on the prices applicable on the date the order was booked, subject to product availability.
5.2 – Any client located outside France is invited to make enquiries concerning customs duties or other taxes which may be applicable to any transactions. The client will be solely liable for the related declarations and the payment of such duties or taxes.
Payment is made in euros € unless the client chooses to pay for his purchases in his own currency by credit card or by PayPal.
5.3 – Retention of title clause: the products remain the entire property of HOSES until HOSES has cashed the full sums corresponding to the price.
ARTICLE 6 – DELIVERY
HOSES delivers throughout France and to most countries. The delivery lead times shown on the website are provided for information purposes only and are non-contractual in nature. Orders are shipped to the address mentioned on the electronic invoice issued at the time the order is confirmed. HOSES will apply the following conditions:

HOSES may not be considered liable for any delays with delivery. It is the client’s responsibility to submit a complaint/claim for all deliveries which are late, damaged or from which items are missing, either at the time of delivery or within a maximum period of three (3) days.
Orders not shipped within a period of thirty (30) days are automatically cancelled, unless this is a specific factor mentioned in the product information sheet on the website (pre-payment for example).
HOSES will issue a refund of any item which the client considers unsuitable, pursuant to the conditions mentioned in article 8.
ARTICLE 7 – PAYMENT
Purchases should be paid for by credit card (the card is debited at the time the order is confirmed): VISA, MASTERCARD, or PAYPAL. It is possible to pay in a currency other than the euro.
Our website uses a secure payment system involving the encryption of sensitive data relating to the means of payment. All information concerning your order is protected and will remain strictly confidential under the responsibility of www.hoses-limited.com and its banking services supplier. The purpose of this automated data processing is to allow for a degree of transaction analysis and to combat bank card fraud. The data recorded by HOSES’ banking services provider constitutes proof of the whole financial transaction occurring between HOSES, the client and the respective banking establishments.
The occurrence of a non-payment incident due to the fraudulent use of a bank card will result in the details concerning your order and the non-payment incident being recorded in a payment incident file maintained by our secure payment operator. An irregular declaration or other anomaly may also result in special processing measures applying.
HOSES reserves the right to refuse any order or delivery in the event of an existing dispute with a client, in the event of total or partial non-payment for a prior order, in the event that authorisation for payment by bank card or by cheque is refused by the banking establishments, or any anomaly in the quantities ordered or with the order itself.
ARTICLE 8 –RIGHT OF WITHDRAWAL
In conformity with the law, the client has a period of fourteen (14) days following receipt to return a product which he considers unsuitable. All returns must be made by registered post after having submitted a request to email@example.com or by telephone on +33 (0)1 42 78 80 62. The return carriage costs will be borne by the client.
Only the price of the product or products purchased will be reimbursed within a period of thirty (30) days following the return, using the same payment method as that chosen by the client when placing the order. (The delivery costs will not be reimbursed).
Only items returned in their original packaging (shoebox, plastic packaging, labels, spare parts, etc.), which are complete, in perfect condition and with no signs of use will be accepted. In particular, returns of clothing which have been washed, worn, damaged or soiled in addition to damaged boxes will be refused.

ARTICLE 10 – PROPRIETE INTELLECTUELLE
10.1 – All text, comments, works, illustrations, images and audio features, including the storage and operating media are protected by copyright, trademarks or patents in addition to intellectual property rights worldwide.
Pursuant to the provisions of the Intellectual Property Code, the only use authorised is private usage subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the website www.hoses-limited.com is strictly prohibited.
Any user wishing to display a link to the HOSES website on any other website must request permission beforehand and obtain the written consent of HOSES. In all cases, all links, even if tacitly authorised, must be withdrawn immediately upon request from HOSES.
In the case of hypertext links pointing to other websites from www.hoses-limited.com, the latter will not be considered liable for the content of the information supplied on these websites after activation of these links.
Any hypertext link pointing to the HOSES website and using the framing or in-line linking technique is formally prohibited.
10.2 – Certain products including among others software are subject to personal and specific rights of use governing copies, public circulation and distribution or leasing/rental. You must comply with the general terms of sale for these products and HOSES will not be considered liable for any use which may be made of the products in this sense.
ARTICLE 11 – LIABILITY
The proposed products comply with applicable French legislation and the standards applicable in France. HOSES may not be considered liable in the event of non-compliance with French legislation (for example if a product is banned).
HOSES will bear no liability except in the case of obvious errors between the characteristics of the product and the manner in which this is represented and/or the terms of sale.
For all stages in accessing its website, HOSES bears only an obligation of due diligence. HOSES may not be considered liable for all nuisance or losses related to the use of the Internet, including among others interruptions with Internet access, intrusions or infection by computer viruses, etc.
ARTICLE 12 – APPLICABLE JURISDICTION – DISPUTE RESOLUTION
The proposed products comply with applicable French legislation. HOSES may not be considered liable in the event of a failure to comply with the legislation of the country to which the products are delivered. It is your responsibility to check with the local authorities concerning the possibilities to import or use the products you envisage ordering from us.
ARTICLE 13 – PERSONAL INFORMATION
HOSES and its service provider for secure payment solutions are the recipients of the personal data gathered during the ordering and payment processes.
HOSES hereby agrees that it will not share the information supplied by its clients with third parties. This information is confidential and will be used only for processing your order.
Some pages on our website may also include web beacons which enable us to count the number of visitors per page. These beacons may be used among other things to measure and improve the effectiveness of our product range. The information obtained thanks to these beacons is strictly anonymous and intended for statistical purposes only.
Pursuant to the French data protection act of January 6, 1978, you have a right to access, rectify and oppose the personal data concerning you.
